A 29-year-old man who spat at a policewoman after smashing his way into his parents' Stonehouse home has had his jail term cut by a quarter after a judge had second thoughts.

On April 7 Judge Jamie Tabor QC jailed Luke Smith, of no fixed address for 48 weeks.

But last Thursday the judge reduced the sentence to 36 weeks under the 'slip rule' which allows him to adjust a sentence within a month of imposing it.

Judge Tabor said he had reflected on the sentence and now accepted a defence subission that he had not taken enough account of the efforts Smith had made while on a probation order before the offence.

Gloucester crown court had heard that Smith committed the offences when he became homeless after splitting up with his partner.

He smashed a window and door of his parents' home in Gloucester Road, Stonehouse on March 28th and was found later after passing out on their sofa.

Prosecutor Janine Wood said when police were called he spat at PC Sian Garland.

Smith pleaded guilty to assaulting the police officer and damaging his parents property.

The court heard Smith, of no fixed address, committed the offences while subject to a suspended prison sentence and supervision after he punched and broke the leg of his former girlfriend’s new lover.
