A 33-YEAR-OLD former jockey from Minchinhampton has admitted a sexual assault on a teenage boy - a charge that he had originally denied at a jury trial earlier this year.

Jurors failed to agree on a verdict in April when Thomas Forster, of Box Lane, Minchinhampton, pleaded not guilty to sexually assaulting the boy when they shared a bed together after a night out.

Yesterday a retrial was due to get under way at Gloucester Crown Court but Forster asked for an indication from the judge of what sentence he would receive if he pleaded guilty.

Judge Jamie Tabor QC said he would pass a suspended jail sentence and Forster then changed his plea to guilty.

The judge bailed him till October 4 for a pre-sentence report to be prepared.

He said he would pass a jail term at the top end of the scale but suspend it and place Forster under curfew for a period of time as a punishment. Forster would also have to go on the sex offenders register, he said.

The judge was told that Forster had no previous convictions and another man had played the 'leading role' in what went on leading up to the offence.

During the trial in April the victim, now 18, said "I had stayed at a friend's house overnight on the Friday.

"On the Saturday morning we were picked up at about 11am by Tom and another person to go tenpin bowling. My friend's step-sister was also in the car.

"I didn't know Tom was coming with us but we went bowling and then to the arcade. We spent about three hours there. Afterwards we took my friend's step-sister home for about 4pm and went to the other person's house.

"We went in to have a fag and an orange juice. The man told me to go to Tesco with Tom to get some wine but I was thinking 'why couldn't I stay here?'"

The man said when he returned he was sweating so his friend told him he could have a shower and get ready to go ice skating later. He thought they left at about 7pm to go to Swindon via a McDonalds near the ice rink.

"We left the ice rink about 10:20pm and returned to the other man's house but we went to Tesco first to get fuel and some chocolate," he said.

The man said they were having a drink, he was drinking Coca Cola and having a cigarette when the other male put some pornography on.

"I told him it doesn't interest me, as I have a girlfriend," he said.

"He had it on an app I think. He said he had more but me and my friend said we didn't want to watch it. He turned it off and we went to go to bed."

The man said it was suggested to him he should sleep in the same bed with Forster but they should 'top and tail.'

He thought he should sleep with his friend as he felt he would be safer as he didn't know Forster.

He described how he got into bed and Forster got in the other side, top and tailing, but after a little while he turned round to his side.

"He tried to kiss me and I pushed him away and told him not to do that as it made me uncomfortable." the man said.

"I told him I didn't like it. He told me he likes boys and he is bi-sexual" said the man.

"I told him I wasn't bi or gay, I am straight and I have a girlfriend."

The man then explained how Forster tried to get him to touch his genitals.

"I told him it wasn't right and he should go to see the doctors or something," said the man "I pulled away and turned to face away from him. We were back to back."

He then explained how Forster attempted to sexually assault him.

The man said it was about 5am before he fell asleep as he wanted to make sure the other man had gone to sleep. He said the next morning the man told him not to tell anyone what had happened.

He later told his friend what had happened on the Monday when they were out together near their homes.
