LUKE Smith smashed his way into his parents’ home and then spat at a female police officer who arrested him, a court was told.

Gloucester Crown Court heard on Monday, April 7, that Smith, 29, committed the offences when he became homeless after splitting up with his partner.

He smashed a window and door of his parents’ home in Gloucester Road, Stonehouse, on March 28 and was found later after passing out on their sofa.

Prosecuting, Janine Wood said when police were called he spat at PC Sian Garland. Smith pleaded guilty to assaulting the police officer and damaging his parents property.

Ms Wood said that after leaving his partner, Smith initially went to his grandmother’s house but was “kicked out” after his father intervened.

“Old habits die hard and he succumbed to alcohol,” she said. “He tried to ring his mum and was banging on the back door before he kicked the door in and smashed the window. He was found passed out. When the police officer attended his parents found him there, intoxicated on the sofa. He spat at PC Garland and she was left with spit on her jacket.”

The court heard Smith, of no fixed address, committed the offences while subject to a suspended prison sentence after he punched and broke the leg of his former girlfriend’s new lover.

Judge Jamie Tabor QC jailed him for a total of 48 weeks.
