GLOUCESTERSHIRE COUNTY COUNCIL CONFIRMATION OF PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER - HIGHWAYS ACT 1980/ WILDLIFE AND COUNTRYSIDE ACT 1981 -GLOUCESTERSHIRE COUNTY COUNCIL - PUBLIC FOOTPATH ROUTE MCH14/15 – CHALFORD PARISH - DIVERSION ORDER 2018
On the 18 May 2018 the Gloucestershire County Council
confirmed the above Order under Section 119 of the
Highways Act 1980 and Section 53(2)(a) of the Wildlife and
Countryside Act 1981. The effect of the Order as confirmed
is to divert a length of public footpath route MCH14/15 as
shown on the Order Plan and described in Part 1 of the
Schedule hereto and to create a new path as described
in Part 2 of the said Schedule. A copy of the Order as
confirmed and plan annexed to the Order (‘Order Plan’)
may be seen free of charge during normal office hours
at Gloucestershire County Council, Shire Hall, Westgate
Street, Gloucester and Stroud District Council, Ebley Mill,
Westward Road, Stroud, Glos, GL5 4UB. Copies of the Order
and Order Plan may be obtained. (Please quote reference
573/11/45(3)). The Order comes into force on 18 May 2018
but if any person aggrieved by the Order wants to question
its validity or that of any provision contained in it on the
ground that it is not within the power of the Highways Act
1980, as amended, or on the ground that any requirements
of the Act, or of any regulations made under the Act has not
been complied with in relation to the Order, he or she may,
under paragraph 2 of Schedule 2 of the Act as applied by
paragraph 5 of Schedule 6 to the Act, within six weeks from
the date on which notice is first published, apply to the High
Court. SCHEDULE Part I - Description of Site of Existing
Path or Way; That length of public footpath numbered
MCH14 on the Definitive Map for the Parish of Chalford
that commences at a point marked A on the Order Plan at
Ordnance Survey Grid Reference (OSGR) SO8856/0331 at
its junction with Public Footpath MCH13 then extends in a
generally south-south-easterly direction for approximately
135 metres to its junction with Public Footpath MCH15 at a
point marked B on the Order Plan at OSGR SO8864/0320
then continues in a south-south-easterly direction for a
further 48 metres to a point marked C on the Order Plan at
OSGR SO8866/0316 at The Frith Road and being shown
by a bold continuous line and being of an undefined width.
Part 2 - Description of Site of New Path or Way; A
length of public footpath commencing at point marked D on
the Order Plan at OSGR SO8865/0329 at its junction with
Public Footpath MCH13 then extends in a generally southsouth-
westerly direction for approximately 100 metres to a
point marked E on the Order Plan at OSGR SO8863/0320
which continues in a generally southerly direction for a
further 31 metres then in an east south easterly direction for
approximately 22 metres to the said point C at The Frith Road
and being shown on the Order Plan by a bold broken line and
having a width of 2 metres between points D-E and 1.5metres
