MADAM – I think we need to cut through the convoluted legal arguments concerning the height of the incinerator and look at the simple facts.

A ministerial ruling confirms an SDC planning decision that if you put an industrial building like a warehouse on Javelin Park, it has to be less than 15.7 metres high.

Unless, according to the GCC Waste Strategy, that same industrial building is an incinerator, in which case it can be pretty well as high as you like.

If a court of law were to rule that this is correct, then in my view the law is not just an ass, it is barking mad.
